Acceptable Guidelines of the Client’s Content for the
Linking News Public Relations Services
Before issuing a Client’s Content over the Linking News Public Relations Services platform, you will have to confirm that you have the right to do so and you have read and understood the Full Terms & Conditions for the Linking News Public Relations Services. If you have any doubt on the related agreements, i.e., Full Terms & Conditions of the Linking News Public Relations Services and Acceptable Guidelines of the Client’s Content for the Linking News Public Relations Services, please do not use these services.
Client shall not include any inappropriate content in the Client’s Content, including any content that:
Fails to comply with applicable laws, statutes, statutory instruments, contracts, or regulations, advertising and marketing codes of practice (whether self-regulatory or otherwise);
Breaches any duty toward, or rights of, any person or entity, including rights of publicity and/or privacy, or any consumer protection laws, or the Intellectual Property Rights of any third party;
Contains any false, deceptive, misleading, unethical, defamatory or threatening material or any obscene, offensive or blasphemous material; or
Is or promotes or advocates pornographic, profane, racist, libelous, gambling-related, discriminatory, offensive or deceptive material.
Client’s Content that does not conform with the requirements set out below may not be distributed.
Certain material news relating to public companies is not appropriate for the Linking News Public Relations Services and may be rejected for distribution (e.g. main shareholder alteration,earnings releases, merger and acquisition announcements, c-level personnel announcements and dividend releases).
If you are a public company, you must include your stock ticker to ensure your press release can be indexed properly on the investor websites and databases. Please use this format:(EXCHANGE: TICKER)
Public companies using the Linking News Public Relations Services must include their ticker symbol in every press release they issue. However, Linking News permits the use of a third party’s ticker symbol only with advanced written permission from that third party. For example: a) companies whose products are sold, bundled, packaged or compatible with those of another company (common in the software industry) must get approval from the company being referenced in their press release before the other company’s ticker will be included in the story; b) companies who list the names of their prominent customers in their press releases must obtain approval from those customers before Linking News will include the associated ticker symbols.
You may not reference a competing company’s ticker in a press release. Linking News’s editorial staff will remove the inappropriate ticker symbols before transmitting the press release.
Once issued by Linking News, press releases are routinely posted by Internet investment sites and online services that may or may not have their own policies regarding the indexing and posting of news from public companies. There is no guarantee that a Linking News press release containing multiple ticker symbols — even with the approval of the companies to whom those tickers belong — will carry all the symbols when posted by these third party online services.
All material transmitted by Linking News may be used by the media with or without attribution. We do not transmit material that is copyrighted by someone other than the source of the press release. For example, Linking News would not distribute a news or article that appeared in another publication unless we have written authorization from the publication itself.
You may not use the Linking News Public Relations Services to distribute Content that are potentially defamatory, inflammatory or libelous. The injured party may be a living individual, business, corporation or association. Examples of Content that potentially could be libelous are those containing allegations of crime, immoral or unethical actions, financial irresponsibility or professional incompetence.
Linking News will not issue Client’s Content regarding lawsuits of any kind.
You may not send press releases through the Linking News Public Relations Services that directly link a celebrity to a product unless that celebrity is a paid spokesperson for that product or has otherwise authorized the use of their name/likeness.
You may not distribute Client’s Content through the Linking News Public Relations Services related to online gaming, including if they link to websites that allow users to place bets for money or directs users to a site that allows them to place bets.
Client is fully responsible for its Content and for obtaining at its own cost any necessary rights clearances from third parties relating to any parts/aspect of the Client’s Content which may be protected by proprietary rights, copyright, neighboring rights (including without limitation, moral rights and performer’s rights) or privacy rights, including but not limited to (a) clearances from people whose name, portrait, image or performance (if any) appear in the Client’s Content and/or (b) clearances in respect of musical works, sound recordings, buildings, works of art, designs, public monuments and/or inanimate objects (if any) contained in the Client’s Content. Where Linking News suffers any loss or losses or is subjected to lawsuit by the Client’s fake authorization materials/permits aforesaid, the Client shall compensate the loss arising therefrom and take effective measures to prevent Linking News from suffering lawsuit and claim.
Client hereby grants Linking News a worldwide license to use, receive, store, copy, display, package, process, manipulate, adapt, sub-license, and distribute Client’s Content (or select portions thereof).
Client shall be clearly identified as the source of the Client’s Content. Client hereby grants Linking News the right to use Client Marks to identify and market the Client’s Content licensed herein and to identify Client as the source of the Client’s Content (or items therein) and to permit Linking News customers to identify Client as the source of any item of Client’s Content.
Additional Indemnity. Without limiting anything in the Agreement, Client shall indemnify Linking News against any direct loss or cost (including but not limited to, reasonable legal fees and costs of investigation) arising out of any claim by a third party relating to or arising out of the Contributed Content.
